1. Parties to the Agreement
This Property Advertising & Booking Services Contract (“Agreement”) is entered into between GoToHabana (“Publisher/Platform”) and the Property Owner (“Client”). Both parties agree to the terms outlined below.
2. Purpose of Agreement
The Property Owner is contracting GoToHabana to:
• Advertise their property on the GoToHabana platform
• Display the property in the Places to Stay Section
• Provide optional booking related services (inquiries, leads, or reservations depending on the selected plan)
GoToHabana agrees to publish and promote the property according to the selected advertising package.
3. Property Owner Responsibilities
The Property Owner agrees to:
• Provide accurate and truthful property information
• Supply photos, descriptions, and details they own or have permission to use
• Ensure the property complies with all local, state, and federal rental laws
• Maintain the property in safe and rentable condition
• Respond promptly to booking inquiries (if applicable)
• Notify GoToHabana of any changes in availability, pricing, or property status
• The Property Owner represents and warrants that the premises subject to this agreement comply with all safety measures required by current regulations for residential use. Furthermore, the LANDLORD undertakes to maintain in good working order all enclosures (doors and windows), as well as electrical and gas installations, in order to safeguard the physical integrity and property of the TENANT.
The Property Owner is fully responsible for the accuracy and legality of all submitted content.
4. GoToHabana Responsibilities
GoToHabana agrees to:
• Publish the property listing in the Places to Stay Section.
• Display the listing according to the selected plan (Basic or Premium)
• Forward booking inquiries or reservation requests (if included in the plan)
• Maintain reasonable uptime and visibility of the listing
GoToHabana does not guarantee bookings, occupancy rates, or financial performance.
5. Payment Terms
Advertising and booking service fees are billed monthly based on the selected plan.
Accepted payment methods include:
• Cash
• Zelle
• PayPal
• Money Order
• Check
Late Payments
• Booking Fee Payments more than 7 days late incur a $15 late fee
• Booking Fee Payments more than 15 days late may result in temporary suspension of the listing
• Booking Fee Payments more than 30 days late may result in permanent removal of the listing and termination of the contract
No refunds will be issued for suspended or removed listings due to late payments.
6. Booking Services (If Applicable)
If the Property Owner selects a plan that includes booking services, GoToHabana will:
• Forward booking inquiries or reservation requests
• Display availability and pricing as provided by the Property Owner
The Property Owner agrees to:
• Honor confirmed bookings
• Provide accurate availability
• Communicate promptly with guests
GoToHabana is not responsible for guest behavior, cancellations, damages, or disputes between guests and the Property Owner.
7. Contract Term & Renewal
This Agreement is billed annually and renews automatically unless canceled with 30 days’ written notice by either party.
8. Content Approval & Removal
GoToHabana reserves the right to:
• Reject any property listing that violates guidelines
• Request edits to misleading, inappropriate, or copyrighted content
• Remove any listing that breaches this Agreement or harms the platform
No refunds will be issued for removed listings resulting from violations.
9. Penalties for Breach of Contract
A breach occurs if the Property Owner:
• Fails to pay on time
• Submits false or illegal property information
• Misrepresents the property
• Violates rental laws or GoToHabana policies
• Fails to honor confirmed bookings (if applicable)
Penalties include:
• Immediate suspension of the listing
• Contract termination
• Possible legal action for damages caused by unlawful or fraudulent content
10. Liability Limitation
GoToHabana is not liable for:
• Loss of revenue, bookings, or business opportunities
• Errors in Property Owner submitted content
• Guest behavior, cancellations, or damages
• Technical issues, downtime, or third party misuse
The Property Owner’s maximum remedy is limited to the amount paid for the current month of service.
11. Indemnification
The Property Owner agrees to indemnify and hold harmless GoToHabana from any claims, damages, or legal actions arising from:
• Their property
• Their rental practices
• Their submitted content
• Guest interactions or disputes
